Freezing Membership

Freezing your Active Card

Freezing is only available to standard account holders, and does not apply to corporate memberships. Freeze requests must be submitted by email or via our website www.active.je

Membership Freezing Requirements

'Annual Advance' Members:  the minimum freeze period is 7 days and the maximum freeze period is 6 months total in any one year of membership. Freezing is free to annual advance members, however, there must be at least 7 days between each freeze period unless you are extending an existing freeze. A minimum of 1 working day notification (24 hours) is required prior to the day the freeze is due to start.. Click Here

'Direct Debit' Members:  the minimum freezing period for direct debit memberships is one complete calendar month with a maximum freeze period of up to 6 months in any 1 year of membership. A fee of £8.00 per month is applicable. A minimum of 5 working days notification is required prior to the month the freeze is due to start. Click Here

Terms & Conditions

General

1. All benefits of the Active membership listed on the 'Price Guide' are subject to change and availability.

2. Certain categories of memberships do not include all the services and facilities. Services and facilities not so included may be provided at an additional charge at Active's discretion.

3. Active reserves the right to make reasonable alterations to the type of facilities provided. When necessary maintenance is required, facilities may be closed. Members will be given at least fourteen days prior notice of any closure. Active shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services. For the avoidance of doubt, Active will not refund membership fees or add any additional freezing facility if the member chooses not to attend the alternative facilities available.

4. Our opening times are available on our website www.active.je or upon request and are subject to changes without any prior notice being given to members. We shall, however, endeavour to give members reasonable notice of change to such hours.

5. In the event of loss or damage to an Active Card, it is the members' responsibility to collect a duplicate card that will be issued at a nominal charge.

Membership Contract

1. Any applicable joining fee is due immediately at the time of registration.

2. Direct Debit memberships are initially set up for a 12 month period.

3. For the avoidance of doubt, after the first calendar year of your Active membership (discounting any "freezing period") you will only need to give one month's full notice (by emailing active@gov.je) in order to cancel your membership.

4. Direct Debit payments are collected from member's accounts within the first 10 working days of the month. If, for whatever reason, we cannot collect the relevant funds, a Direct Debit rejection charge of £5.00 will apply in addition to the payment in arrears.

5. Active reserves the right to increase Active membership fees throughout the year. Active members will be notified at least 10 working days prior to any changes being made.

6. At the end of the first calendar year of your full Active Card membership (discounting any "freezing" period) the subscription will automatically extend on a one month roll over basis, without formal notice, at the relevant price applicable on the annual renewal date. 

7. A full paying adult member is entitled to have one of their children added to his/her membership at no extra cost providing that the child is under the age of 18.

8. The Exercise Referral discounted price is only valid for the first 12 months following registration. For the avoidance of doubt, after this period, the full price will apply at the time of renewal.

9. The Senior Citizen membership is only available to customers who are in receipt of a Jersey Social Security pension or over the age of 65 (proof is required at the time of registration).

10. The Monthly Student membership is only available to customers in full-time education (proof is required at the time of registration).

11. The Youth membership is only available to young persons under the age of 19 (proof of age is required at the time of registration).

12. Management reserves the right to withdraw, without refund of any fees, any Active Card used by any person other than the cardholder.

13. Active shall not refund membership fees where the member chooses not to attend the facilities.

Corporate Membership Contract

1. A Corporate Membership only applies to employees of the company. You can link to your account your partner or an immediate family member or a friend. The same payment method will apply, from the same bank account details, when applicable.

2. Corporate Memberships are set up for 12 months from the start of the contract.

3. Members of the Corporate Membership Scheme can only cancel their initial subscription at the end of their contract. Should you wish to terminate your agreement earlier, you can do so providing you can find someone (from the same company) to replace your contract.

4. The Corporate rate is dependant on the number of members within the scheme. If the number of members increases within the 12 month period, the new membership discount will not apply until the renewal date.

5. Members, who pay in advance but leave the company during their contract, will only be able to renew their memberships at the standard applicable rate, not under the corporate scheme.

6. Members, who pay by Direct Debit but leave the company during their contract, can transfer to a standard membership at the relevant applicable rate.

7. It is not possible to cancel a Direct Debit without informing the main Corporate Contact and the Active Membership Team.

8. Corporate Memberships are only available providing someone within the company (the contact person) assumes responsibility for the Scheme and its administration.

9. Existing Active members can transfer to a Corporate Scheme by contacting the Active Membership Team and making the relevant arrangements but only providing that they are not in an existing contract.

10. Members will receive either an email or a letter at the time of renewal (after the initial one year contract). Unless we receive a response to the email or letter (by emailing active@gov.je) requesting to cancel your membership, on expiry of the first calendar year of your Corporate membership starting from the date of this contract, the subscription will automatically roll over on a month by month basis, without formal notice, at the relevant price applicable on the renewal date and monthly thereafter. For the avoidance of doubt, after the first calendar year of your corporate membership you will only need to give one month's notice in order to cancel your membership.

Membership Freezing

1. There is NO freezing option for the six months; Corporates; Trial; Off Peak; Student/ Youth; Monthly Gym and Swim pass options.

2. For the avoidance of doubt, if the freezing option is available for your membership type, this is to cover all eventualities such as illness, holidays and centre closures.

3. If you wish to freeze your account and pay by Direct Debit, we require written notification five working days prior to the month you wish to freeze. A minimum of one calendar month and maximum six calendar months freeze facility is available to members on standard contracts. The relevant membership freeze fee will apply.

4. If you wish to freeze your account and pay annually, we require written notification three working days before the day you wish to start the freeze. A minimum of seven days and maximum of six months freeze facility is available to members on standard contracts. Please note that there must be at least seven days between freeze requests.

Health & Safety

1. The member warrants and also represents that they are in good health and are not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well being or physical condition.

2. For members wishing to use only cardiovascular equipment an induction is optional, for all other equipment inductions are necessary at all centres.

3. Gym Entry: Junior gym users are those between the ages of 8 - 14 years of age. This age group is only eligible to use the Junior Gym equipment which has been specifically designed for juniors. This must be on a supervised basis only either by qualified instructors or through schools or specific classes. Juniors from the age of 14 are allowed to use normal CV equipment if accompanied by a parent or guardian 18 years or older. Juniors from the age of 16 + are allowed to use resistance equipment/free weights.

4. Active Class Entry: The Active class programme has been designed with adults in mind.  Some classes may be appropriate for 14 - 16 year olds if accompanied by an adult and at the instructor's discretion. Under 14s are not permitted to participate in Active classes.

5. Complimentary children's memberships - children aged 16+ may attend classes on an 'On Spec' basis only. For the avoidance of doubt, this offer may be subject to review and withdrawn, by management, at any time without formal notice.

6. Health commitment statement: The Health Commitment statement must be read and signed by all gym users.  An adult or guardian (18 years or older) must also sign juniors' health commitment statement. A member of staff must witness both the junior and the parent or guardian signing the statement. 

Access & Bookings

1. Sports bookings can be made up to seven days in advance. The management reserves the right to impose a penalty charge with the cancellation of a booking with less than 24 hours' notice. This notice may also result in suspension of an Active Card until such time as the appropriate fee is paid even if the facility is reallocated. The Management reserves the right to limit the number of bookings in respect of any activity.

2. On spec racquet sports bookings (15 minutes before the court is available) are complimentary at any time when the facilities are open.

Marketing

1. We may use the information we collect to occasionally notify you about important functionality and/or changes to the website, new Active services and special offers we think you will find valuable.

2. We reserve the right to disclose information about member usage and demographics to advertisers and partners, but in anonymous, aggregate form only.

3. We require users to provide us with name, e-mail address, postal address, postcode, gender and date of birth in order to register for access to certain services. We may also ask for other non-mandatory demographic information from members, including number of children and occupation. This information is stored by our data processors and will not be disclosed to other parties.

4. We may perform statistical analyses of user behaviour in order to measure relative consumer interest in various areas of our membership (for product development purposes) and to inform advertisers as to how many consumers have seen it. In performing these statistical analyses, we will disclose information to third parties only in aggregate form.

5. We may share your information with reputable and trustworthy organisations. We may contact you by mail, telephone, SMS or e-mail to let you know about any goods or services or promotions, which may be of interest to you. When you give us your personal information, we will give you the opportunity to opt out of receiving such information from us but remember that this will preclude you from receiving any of our special offers or promotions in future.

6. You may also exercise your right to opt out of the use of your information for marketing purposes at any time by contacting us.

7. We may continue to use member's details for marketing purposes on expiry of membership, unless the member's request to have their details deleted. 

8. When you visit our website, we may send you a cookie. A cookie is a small file that can be placed on your computer's hard disc for record keeping purposes and we may use them to do a number of things:

• Cookies help us to recognise you when you next visit one of our websites and note advertisements displayed to you. This allows us to tailor the advertisements we provide to your preferences. We may use the services of third party ads servers for this purpose.

• Cookies may be used to compile anonymous statistics related to the take up or use of services, or to patterns of browsing. A third party collects such data on our behalf to measure web site performance. Information collected is aggregated for reporting purposes. No personally identifiable information is collected by this service. The use of this service assists us in measuring and improving the structure and ease of use of our websites.

• You are not obliged to accept cookies and may modify your browser so that it will not accept cookies.

9. Active is collecting your personal information for the purposes of administering your Active membership. We may wish to send you information about benefits and services associated with being an Active member. Please tick the box on the cover page if you do not wish to receive this information. Your personal information will not be passed to any third parties without your prior consent.

Notwithstanding any legal action, the management reserves the right at all times to withdraw, without refund, the membership of any Active Card holder failing to comply with these conditions, misconduct themselves or in any way causing damage or annoyance to other persons.
